Data Deletion & Retention Policy

1. Purpose & Scope

This Data Deletion and Retention Policy ("Policy") governs the collection, storage, retention, and deletion of personal and financial data by DIVISIONSIX-20-ONE ("Organization"), operating under the brands Sarah - D6 JCOM and VMCX (Vague Media Company X), through the VMCX platform, accessible at vmcx.mx. This Policy applies to all users, employees, contractors, and third-party integrations that process personal data on behalf of the Organization.

This Policy has been established in compliance with applicable data privacy regulations, including but not limited to the California Consumer Privacy Act (CCPA), General Data Protection Regulation (GDPR) principles, and applicable U.S. federal and state privacy laws.

3. Data Deletion Procedures

The Organization has implemented the following enforceable deletion procedures:

  • User-Initiated Deletion: Any registered user may submit a deletion request by contacting admin@vmcx.mx. Upon receipt, account data will be purged within 30 days, except where retention is required by law.
  • Account Inactivity: Accounts with no login activity for 24 consecutive months will be flagged for administrative review and scheduled for deletion with 30-day advance notice sent to the registered email.
  • Financial Data: Transaction and ledger records are retained for 7 years per IRS guidelines. After this period, records are permanently and irreversibly deleted from all systems.
  • Plaid Access Revocation: Upon user request or account deletion, Plaid access tokens are immediately revoked via Plaid's API. No bank account numbers or credentials are ever stored by the Organization.
  • Backups: Deleted data is removed from live systems within 30 days and from backup systems within 90 days.
  • Third-Party Processors: Upon account deletion, the Organization submits deletion requests to applicable third-party data processors (Plaid, Twilio, Stripe) per their respective data processing agreements.

4. Legal Compliance Framework

This Policy is designed to comply with the following applicable laws and standards:

  • CCPA (California Consumer Privacy Act): Users have the right to know, access, delete, and opt-out of the sale of personal data. VMCX does not sell personal data.
  • GDPR Principles: Data is processed lawfully, fairly, and transparently; collected for specified purposes; limited to what is necessary; accurate; retained no longer than necessary; and processed securely.
  • GLBA (Gramm-Leach-Bliley Act): Financial data processed through Plaid integrations is handled with appropriate safeguards consistent with GLBA requirements.
  • IRS Recordkeeping Requirements: Financial records are retained for a minimum of 7 years.

5. Policy Review & Enforcement

This Policy is reviewed and updated at minimum annually, or whenever significant changes occur to:

  • Applicable laws or regulations
  • Platform data processing practices
  • Third-party integrations (e.g., addition of Plaid or new financial processors)
  • Organizational structure or data handling workflows

The Organization's administrative leadership is responsible for enforcing this Policy. Any violations are subject to internal disciplinary procedures and, where applicable, reporting to relevant regulatory authorities.

6. User Rights

Users of the VMCX platform retain the following rights regarding their data:

  • Right to Access: Request a copy of all personal data held by the Organization.
  • Right to Correction: Request correction of inaccurate personal data.
  • Right to Deletion: Request permanent deletion of personal data, subject to legal retention requirements.
  • Right to Portability: Request personal data in a structured, machine-readable format.
  • Right to Object: Object to processing of personal data for specific purposes.
